OUR TEAM
Attorney at Law from Universidad Del Valle de México, where he obtained the bachelor degree in Law. He began his professional practice in 1995, in the legal firm Calderón y de la Sierra.
His practice has been focused mainly on contentious area, in the study, preparation, filing and follow-up of the lawsuits filed before the Mexican Institute of Industrial Property, the National Copyright Institute, Fiscal Courts, Federal and Collegiate Tribunals, in matters related to Intellectual Property.
In 2009, Mr. Tovar decided to found the firm Tovar & Cruz in order to continue with his practice in matter of intellectual property and corporate law.
Mr. Tovar García handles Spanish and English languages.

Attorney at Law from Universidad Tecnológica de México, where she obtained the bachelor degree in Law; with Masters’ degree from Universidad Panamericana of Mexico City. She began her professional practice in 1992 in the law firm Calderón y de la Sierra.
Her professional practice has been focused mainly on procedures of infringement, nullities, cancellation actions and similar cases, including nullity lawsuits before The Federal Tribunal on Administrative Matters, Shelter appeals and in the Patents area.
In 2009, Mrs. Cruz decided to found, together with Mr. Tovar, the firm Tovar & Cruz in order to continue with her professional practice of intellectual property and corporate law.
Mrs. Cruz dominates Spanish and English languages.

Atenas Pérez is currently attending Engineering in Digital Systems and Robotics at the Technological Institute of Higher Studies of Monterrey (ITSEM) in Mexico City.
Atenas joined the firm TOVAR & CRUZ, from 2017. Her practice focuses on all aspects of Mexican trademark law and has extensive experience with trademark prosecution and counseling, as well as proceedings before the IMPI
She also speaks Spanish and English languages.

Mrs. Mejía has been working for foreign companies in the merchandising area, such as Quaker de México, S.A. de C.V.; Warner-Lamber México, Productos de Maíz S.A. de C.V., nowadays Unilever.
As of November of 2014, Mrs. Mejía decided to join to the firm Tovar & Cruz in order to be in charge the administrative area of therein.

Mr. Lorenzo Pérez is responsible for it. He is Chemical Engineer from Universidad Autonomy de México. He began his professional career in the Mexican Institute of Industrial Property, in the Patents area; he was a sub-manager of the in-depth examination of the said Institute.
Mr. Pérez has a specialty of Intellectual Property form the Universidad Panamericana.
He offered his professional services in diverse legal firms of intellectual property since 2000 and since the year 2013, he decided to offer his services to the firm Tovar & Cruz in the Patent area.

Mrs. Yolanda Tapia is responsible for it; with a bachelor degree of Tourism from The Instituto Politécnico Nacional, with 19 years of experience, mainly in the Intellectual Property.
Over the last fifteen years, our translator has been working in an important firm of Intellectual Property in Mexico, in the Patents area of industrial, technical, scientific, medical and legal areas.

TRADEMARKS
The goal of trademark is to distinguish products and services of their competitors. The Industrial Property Law regulates the distinctive signs. However, the exclusive use only is obtained by their registry. Thus, the distinctive signs are divided in Trademarks, Commercial Slogans, Commercial Names and Designations of Origin.

These are the rights that have the artist of their artistic and literary works. Thus, the artist is recognized as the only creator and owner of its work and over which the Copyright Federal Law identifies the rights that have the artist and its work.
Examples of works are: Literary, Musical with or without lyrics, Dramatic, Dance, Pictographic or Drawing, Sculpture and Plastic Character. Cartoons and Comics, Architectonic and Cinema and other audiovisual works, Radio and Television Shows, Software, Photo, Art works including graphic and textile design and of Compilation, integrated by the collections of works, such as encyclopedias, anthologies and of works and other elements as the data basis. Also, among the copyright, the right reserves are protected as the newspaper header, magazine and radio or TV shows among others. Related Rights (performers of a work, producers of phonograms and audiovisual material, books publishers), Certificates to Request and Content, ISBN and ISSN to books and magazines. Dispute Settlement, Contracts derived from copyright.

PLANT VARIETY
In Mexico there is the protection of improvement that gets and develops a plant variety of any gender or type. A breeder, according with the Federal Law of Plant Varieties, is a moral or physical person that obtains and develops a plant variety by an improvement process (Subdivision of a type that includes a group with similar characteristics and which is considered stable and homogeneous) of any gender and type.
In such a way, Federal Law of Plant Varieties establishes that rights that give herein, among others are, the benefit and exploit in an exclusive and temporal way, by itself o by third parts with its permission, a plant variety and its propagation material for its production, reproduction, distribution or sale, as well as the production of other plant varieties and hybrids with commercial purposes, this right has effect by 18 and 15 years.
The rights of the breeder are the legal recognition as the creator of a plant variety, the exclusivity to exploit the variety.
